These Terms of Service constitute a legally binding agreement between you and HOSPUP (see Legal Notice). By accessing or using the Hospup platform, you agree to be bound by these Terms.

By accessing or using the Hospup platform ("Service"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.
By creating an account, you confirm that:

Hospup is a Software-as-a-Service (SaaS) platform providing video creation and social media content generation tools for hospitality businesses. The Service includes:
Video template selection and customization
Upload and storage of video footage and images
Import of content from third-party platforms
AI-powered caption and description generation
AI-powered video generation from photos (photo-to-video)
Video rendering and download capabilities
Accommodation management features
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

You are responsible for:
We reserve the right to suspend or terminate your account at our sole discretion for any violation of these Terms.

You retain all ownership rights to the content you upload ("User Content"). By uploading content, you grant Hospup a non-exclusive, worldwide, royalty-free license to use, process, store, and display your content solely for providing the Service.

The Service allows you to generate animated video clips from static photos using artificial intelligence. By using this feature, you acknowledge and agree that:
Any music or audio used in your videos must be properly licensed. You are solely responsible for obtaining appropriate licenses. Hospup is not responsible for any copyright infringement claims related to music or audio in your content.
AI-generated content (including captions, descriptions, and videos generated from photos) may require review and editing. You are responsible for reviewing all AI-generated content before publication. Hospup does not guarantee the accuracy, quality, or appropriateness of AI-generated content.

You agree NOT to use the Service to:
We reserve the right to remove any content and terminate accounts that violate this policy without notice or refund.

The Service offers free and paid subscription plans. Paid plans are billed monthly or annually.
Payments are processed securely through Stripe. By subscribing, you authorize recurring charges to your payment method.
Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through the Stripe customer portal.
Prices exclude applicable taxes (including VAT). Taxes are calculated at checkout based on your location.
Subscriptions are non-refundable. Upon cancellation, you retain access until the end of your current billing period. No partial refunds for unused time.

Each plan includes specific usage limits. Quotas reset monthly on your billing date. Unused quota does not carry over. Exceeding limits may restrict certain features.

Upon account termination:
Content may be retained for up to 30 days after closure
After this period, content will be permanently deleted
We are not responsible for backing up or recovering deleted content
Download any content you wish to keep before termination

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSPUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Hospup and its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

The Service, including its content, features, functionality, software, and design, is owned by Hospup and protected by international intellectual property laws.
Video templates are licensed for use within the Service only. You may not redistribute, resell, or sublicense our templates.

We may terminate your account immediately, without prior notice, for any breach of these Terms. Upon termination:

First, attempt to resolve the dispute by contacting us at contact@hospup.com. We commit to responding within 30 days.
If amicable resolution fails after 60 days, either party may propose mediation before a mutually agreed mediator. Mediation costs shall be shared equally.
Only if amicable resolution and mediation are unsuccessful may either party pursue litigation in accordance with Section 15.

These Terms shall be governed by the laws of France. Subject to the dispute resolution process in Section 14, any disputes shall be subject to the exclusive jurisdiction of the courts of Nice, France.
For EU consumers, this does not affect your rights under consumer protection laws of your country of residence.

The Service is operated from France and intended for global use. By accessing the Service from outside France, you agree to comply with all applicable local laws.
We make no representation that the Service is appropriate for use in all locations. Users are responsible for compliance with local laws where access is prohibited.
For users in the European Union, we comply with GDPR. For users in California, we comply with CCPA. Please refer to our Privacy Policy for details.

We may modify these Terms at any time. Material changes will be notified by:
Continued use after changes constitutes acceptance.

If any provision is found unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and remaining provisions remain in full force.

These Terms, together with our Privacy Policy and Legal Notice, constitute the entire agreement between you and Hospup regarding the Service.
